Can I charge a fee to provide a broker price opinion or comparative market analysis to an owner, 买家, 或银行?
是的. The Real Estate License Act and TREC规则 permit a broker to charge a fee for providing a broker price opinion (BPO) or a comparative market analysis (CMA). A sales agent may provide a BPO or CMA as well, but they must be submitted in a broker's name. The broker is responsible for a BPO or CMA submitted by a sales agent.
BPOs and CMAs are not appraisals. Appraisals may only be completed by someone who is licensed or certified as an appraiser. 因此, TREC规则 require that BPOs and CMAs contain the following statement verbatim in at least 12-point font:
"This represents an estimated sale price for this property. It is not the same as the opinion of value in an appraisal developed by a licensed appraiser under the Uniform Standards of Professional Appraisal Practice."
So if an Agent were to charge a fee for a BPO then the fee would have to be paid to the Broker as is the case with a commission?
很好的问题. I would think that if the BPO or CMA has to be submitted in the Broker’s name, the fee
会去找经纪人吗. Then the Broker would pay you the fee per his criteria and guidelines.
好 . Excellent info and advice. BT
If the agent emails the owner just a sales price with no stated comparable properties used and charges $500 after the fact, is the owner responsible to pay?
